1. Acceptance of Terms

Welcome to DOYO, a learning management platform operated by Viento Tecnologías ("we", "us", "our", or "DOYO"). By accessing or using our services, you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, you must not access or use our services. We may modify these Terms at any time, and your continued use of the services constitutes acceptance of such changes.

2. Description of the Service

DOYO is a multi-tenant SaaS platform that allows users to create, manage, and sell online courses. Our services include:

• Course creation and management tools
• Student management system
• Payment processing through Stripe
• Media content hosting
• Certificate system
• Analytics and reporting tools
• E-commerce features (shopping cart, checkout)

3. Account Creation and Management

3.1 Registration

To use DOYO, you must create an account by providing accurate and complete information. You are responsible for keeping your credentials confidential and for all activities that occur under your account.

3.2 Eligibility Requirements

You must be at least 18 years old to create a DOYO account. By registering, you represent that you have the legal capacity to enter into this agreement.

3.3 Account Security

You are responsible for notifying us immediately of any unauthorized use of your account. We will not be liable for losses arising from the unauthorized use of your account.

4. Plans and Subscriptions

4.1 Available Plans

DOYO offers different subscription plans with varying features and limits. Details for each plan are available on our pricing page.

4.2 Billing

Subscriptions are billed in advance on a monthly or yearly basis, depending on the plan selected. By subscribing, you authorize DOYO to automatically charge your payment method each billing period.

4.3 Price Changes

We reserve the right to modify our prices. We will notify you at least 30 days in advance of any price change affecting your subscription.

4.4 Cancellation and Refunds

You may cancel your subscription at any time from your account settings. We do not offer refunds for partially used subscription periods, but you will retain access to the services until the end of the current billing period.

5. Acceptable Use

By using DOYO, you agree to:

• Comply with all applicable laws and regulations
• Not infringe on third-party intellectual property rights
• Not distribute malware, viruses, or malicious code
• Not engage in fraudulent or deceptive activities
• Not attempt to access systems or data without authorization
• Not reverse engineer our services
• Not use the service for illegal, defamatory, or offensive content
• Not engage in activities that could damage, disable, or overload our services

6. User Content

6.1 Ownership

You retain all ownership rights to the content you create and publish on DOYO (courses, lessons, educational materials). We do not claim ownership of your content.

6.2 License to DOYO

By publishing content on DOYO, you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and display your content solely to provide and improve our services.

6.3 Content Responsibility

You are solely responsible for the content you publish. You warrant that you have all the rights necessary to publish such content and that it does not infringe third-party rights.

6.4 Content Removal

We reserve the right to remove content that violates these Terms or that we consider inappropriate, without prior notice.

7. Payments and Transactions

7.1 Payment Processing

Payments are processed through Stripe. By using our payment services, you accept Stripe's Terms of Service. DOYO does not store credit card information.

7.2 Fees

Depending on your plan, we may charge a commission on transactions processed through DOYO. Commission rates are specified in your plan details.

7.3 Taxes

You are responsible for determining and paying all taxes applicable to sales made through your school on DOYO.

8. Intellectual Property

DOYO and its components (software, design, trademarks, logos) are the property of Viento Tecnologías and are protected by intellectual property laws. No ownership rights over the platform are granted to you.

The license to use DOYO is limited, non-exclusive, non-transferable, and revocable under these Terms.

9. Privacy and Data Protection

Your privacy matters to us. Our Privacy Policy explains how we collect, use, and protect your personal information.

By using DOYO, you consent to the processing of data in accordance with our Privacy Policy.

10. Limitation of Liability

DOYO is provided "as is" and "as available". We do not warrant that the service will be uninterrupted, secure, or error-free.

To the maximum extent permitted by law, Viento Tecnologías will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use DOYO.

Our total liability will not exceed the amount you paid for the services in the 12 months prior to the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless Viento Tecnologías, its directors, employees, and agents from any claim, loss, liability, damage, or cost arising from:

• Your use of DOYO
• Your violation of these Terms
• Your violation of third-party rights
• Content you publish on the platform

12. Termination

We may suspend or terminate your access to DOYO immediately, without prior notice, if:

• You violate these Terms
• You fail to pay applicable fees
• Your use poses security risks or harm to others
• Required by law

Upon termination of your account, you will lose access to your data. We recommend exporting your data regularly.

13. Dispute Resolution

These Terms are governed by applicable law. Any dispute related to these Terms or the use of DOYO will be resolved through binding arbitration.

14. General Provisions

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Our failure to exercise or enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

15. Changes to the Terms

We may modify these Terms at any time. We will notify you of significant changes by email or through a notice on the platform.

Your continued use of DOYO after such changes constitutes your acceptance of the new Terms.
